(TRINIDAD EXPRESS) – A PATIENT who touched a doctor’s breast while she attended to him at the hospital has been jailed for six months.
Michael Bhagaloo, 25 of Tabaquite Road, Rio Claro was charged with indecent assault. He faced San Fernando senior magistrate Cherril-Anne Antoine.
Police prosecutor Cleyon Seedan told the court that it was at 2 p.m. on April 4 that the female medical doctor reported to police that she was attending to a man known to her as Michael.
They were at the Accident and Emergency Department at the San Fernando General Hospital. Bhagaloo told the doctor “Yuh getting fat and your breasts getting big” and he fondled her left breast.
After making the report at the police station, the doctor later pointed Bhagaloo out to officers as the person who fondled her. Asked if he heard the woman’s words, Bhagaloo said, “Yes officer, I touch she but I tell her sorry.” Constable Piper charged him with indecent assault.
According to a victim impact statement the doctor said she was became afraid during the incident and is in fear that it will happen again with another person. She knew Bhagaloo before last Wednesday’s incident.
Seedan said Bhagaloo had a clean criminal record.
Defence attorney Annalee Girwar confirmed this and also said her client was remorseful. She said Bhagaloo had limited education and received disability grants as he suffers from “congenital defects”.
These she said included and were not limited to him having no nails on any of his finger or toes.
She also said Bhagaloo had no teeth. Girwar said her client’s family suffers genetic defects.
Antoine sentenced him to six months in prison.
